Terms and conditions

These rules set out the rules for the use of the online store and the conditions for making purchases. Last edit: 22.04.2024r.

§1 General provisions

1. The owner and administrator of the online store reperaturki.pl available at the Internet address: https://reperaturki.pl, is BOLMA Maciej Błaż, Kamionka Mała 192, 34-602 Laskowa, NIP 737-179-99-98, REGON 120500899, account number BS Limanowa 32 8804 0000 0000 0026 2440 0001

2. The object of the online store reperaturki.pl is retail and wholesale of, among other things, car body parts.

3. In matters not regulated by these Regulations, the relevant provisions of the law in force in the territory of the Republic of Poland shall apply, in particular: of the law of April 23, 1964 - Civil Code (Dz. U. nr 16, poz. 93 ze zm.), The Act of July 27, 2002 on the special conditions of consumer sales and amending the Civil Code. (Dz. U. nr 141, poz. 1176 ze zm.), Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Dz. U. nr 22, poz. 271 ze zm.) and the Act of August 29, 1997 on the protection of personal data (text jedn.: Dz. U. z 2002 r. nr 101, poz. 926 ze zm.).

4. The provisions of these Regulations are not intended to exclude or limit any rights of the Customer who is also a Consumer within the meaning of the Act of 23 April 1964 - Civil Code. (Dz. U. nr 16, poz. 93 ze zm.), entitled to him under the mandatory provisions of law. In the event of any inconsistency between the provisions of these Rules and Regulations and the aforementioned regulations, these regulations shall prevail.

§2 Definitions

1. STORE - online store available at: https://reperaturki.pl.

2. SELLER - Maciej Błaż, Kamionka Mała 192, 34-602 Laskowa, NIP 737-179-99-98.

3. BUYER - a natural person, a legal person and an organizational unit without legal personality, to which the law grants legal capacity, purchasing products through an online store, available at the address: https://reperaturki.pl.

4. ORDER - an offer made by the buyer through the online store to conclude a contract of sale.

5. USER - any entity using the online store.

6. ACCOUNT - user's individual administrative panel available after registration and logging in to the Online Store, marked with a login and password, used to conclude sales agreements.

7. REGISTRATION - the process involving the creation of an Account by the User in the online store. This process is voluntary.

8. SALES CONTRACT - contract for the sale of goods concluded between the Seller and the Buyer through the online store.

9. GOODS - any item sold through an online store.

10. CONSUMER - an individual purchasing products through an online store: https://reperaturki.pl for a purpose not directly related to its business or professional activity.

§3 Registration

1. Registration in the online store is voluntary and free of charge, it is not necessary to make purchases.

2. In order to register with the store, the user should fill out the registration form located on the store's website, providing his/her real data.

3. The user is required to provide the following data in order to successfully complete the registration process:

a) Email

b) Password

4. In addition to the data indicated in paragraph 3 above, the User who is not a Consumer within the meaning of Article 221 of the Civil Code, is required to provide additionally:

a) Company Name

b) NIP

5. After the User fills in the fields of the registration form with the required data, a User Account is created.

6. In the event that the User's data required during the registration process changes, the User is invited to update it as far as possible to bring it into line with reality.

7. In a situation where the User's data required during the registration process changes after the start of the order processing, the User is asked to update it if possible and inform the store about it.

§4 Orders

1. Customers can place orders at the store 24 hours a day, 7 days a week, through the website: https://reperaturki.pl.

2. The store sells in the Republic of Poland as well as abroad.

3. Information about products presented on the store's website does not constitute an offer within the meaning of the Civil Code; it is an invitation to conclude a sales contract.

4. Placing an order constitutes an offer within the meaning of the Civil Code, made by the customer to the seller.

5. Registration and creation of an account is not a prerequisite for placing an order in the store: https://reperaturki.pl. The customer has the opportunity to place an order without prior registration.

6. In order to place an order, the customer should add the goods he intends to buy to the shopping cart. Adding a product to the cart is not equivalent to placing an order, goods can be added or removed from the cart.

7. The shopping cart allows the customer to manage the ordered goods and recalculate the value of the order.

8. To finalize the order, add the products of your choice to the shopping cart, specify the type of shipping and the form of payment, then choose the option to place the order and follow the instructions given. The customer can place an order after logging in to his account, or if there is no account, providing in the form the data necessary for the seller to execute the contract.

9. Once a valid order is placed, the order is considered accepted. Orders placed in this way are confirmed by e-mail. Thus, the moment of conclusion of the contract is considered to be the sending of a feedback to the customer with confirmation of the order acceptance.

10. The ordered goods will be delivered to the address specified by the Buyer.

11. The buyer can make changes to the order until the Seller sends an E-mail confirming that the ordered products have been shipped.

12. The customer can withdraw or modify the order placed by phone at the number: +48 697 619 800 or by Email, at: [email protected].

13. It is not possible to cancel an order for a product that has already been shipped.

14. Order processing takes place on weekdays.

§5 Payment method

1. All prices in the Store are gross prices, including tax at the rate prescribed by separate regulations. The cost of delivery of goods to the customer is given separately.

2. The customer can choose from the following forms of payment:

a) by bank transfer - payment to the store's bank account: https://reperaturki.pl the full value of the order calculated in the calculation, before delivery of the ordered goods.

b) payment in cash - on delivery

c) payment by bank transfer through PayU

3. The buyer shall purchase the goods and order delivery service (if any) at the prices and delivery costs in effect at the time the order is placed.

4. The Seller reserves the right to change prices and the amount of delivery costs, in particular in the event of changes in the price lists of services provided by delivery operators. This provision does not apply to orders already in progress. If the form of payment described in subsections a and c of Section 2 is selected, failure to pay for the ordered goods within 10 working days from the date of the order, results in cancellation of the order. This does not preclude the Buyer from placing a new order for the same goods.

5. The customer has the opportunity to choose the method of payment for the ordered goods in the store. The seller, being open to the needs of the buyer, can conduct individual arrangements with him on the method of payment.

§6 Delivery performance

1. Delivery is made to the address indicated by the Buyer in the order within the timeframe specified when the product is presented.

2. A receipt is issued for each order, or a VAT invoice upon request.

3. Ordered goods are delivered via third-party courier companies.

4. All costs associated with the delivery of goods on Polish territory, is paid by the Buyer. Unless otherwise agreed with the Seller. With free delivery, shipping costs are covered by the Seller.

5. Foreign shipments are carried out by courier service, or the Polish Post Office.

6. If the Seller cannot perform due to the fact that the goods are not available, he will immediately, no later than within 7 days from the conclusion of the Contract, notify the Buyer, who will decide on the further fate of the order placed by him.

7. If the Seller cannot perform a service with the characteristics individually ordered by the Customer due to the temporary impossibility of its fulfillment, the Seller may, with the consent of the Customer, perform a substitute service, corresponding to the same quality and purpose and for the same price or in another manner agreed by the parties.

8. The Seller, bearing in mind the comfort of the Buyer, as well as safety in the execution of the order, ensures that any inconvenience at any stage of the order - should it arise - will be consulted with the Buyer and implemented by mutual agreement of the parties. The Seller shall make every effort to ensure that the Buyer is satisfied.

9. The lead time is indicated next to the goods and applies to shipments made within Poland.

10. It is recommended that the Buyer, who is also a consumer within the meaning of Article 221 of the Civil Code, if possible, inspect the goods after delivery and in the presence of a representative of the delivery operator (courier, postal operator, etc.) and write an appropriate protocol in case of damage to the goods. Inspection of the shipment will facilitate and expedite the assertion of any claims against the responsible entity in the event of mechanical damage to the shipment occurring during transport. In such situations, it is recommended that the Buyer contact the seller as soon as possible.

11. The Customer, who is not a consumer within the meaning of Article 221 of the Civil Code, is obliged to check the condition of the goods after delivery and in the presence of a representative of the delivery agent(courier, postal operator, etc.). If mechanical damage to the consignment during transport is found, the Customer should write a damage protocol and immediately contact the Seller.

§7 Refunds

1. The buyer, who is also a consumer, who has concluded a contract at a distance, may withdraw from it without giving any reason, making a statement to that effect in writing within 14 days from the date of delivery to Mu of the subject of the contract. To meet this deadline it is sufficient to send the statement before its expiration. Immediately after making the statement, the buyer is obliged to return the object together with the proof of sale to the address of the store within 30 days. The statement can be sent electronically to the address: [email protected], or by mail to the store's address.

2. Along with the statement referred to in item. 1, the Buyer is also asked to send information about the current account number to which the refund should be made.

3. In accordance with applicable law, the cost of delivery of goods to the Seller, shall be borne by the Buyer.

4. Returns of goods are at the expense of the Buyer.

§8 Final provisions

1. Changes to the content of these Regulations may be made after informing the Users of the scope of the anticipated changes no later than 14 days before the date of their entry into force.

2. Orders placed during the validity of the previous version of the regulations will be carried out in accordance with its provisions. If the User does not agree with the amendments to the regulations, he may delete his Account. Any disputes arising between the Seller and the Customer, who is a consumer within the meaning of Article 221 of the Civil Code, will be resolved by a court of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure.

3. Any disputes arising between the Seller and the Buyer, who is not a consumer within the meaning of Article 221 of the Civil Code, will be settled by the court of competent jurisdiction for the seat of the store.

5. Customers may access these Terms and Conditions at any time via a tab on the home page of the online store. The Terms and Conditions may be recorded, obtained and reproduced by printing them out or saving them on a suitable data carrier.

6. Name of the online store: reperaturki.pl, the address of the site at which it is available and all materials contained therein are subject to copyright and are protected by law. The use and distribution of them without the permission of the store owner is prohibited.
